If wills are not validly executed for a variety of reasons, or if the person making a will was unduly influenced by someone else, the will can be invalidated.  If the contestant of a will is successful, a prior valid will is what would be probated, or, if there is no other valid will, the laws of intestacy would apply.

If the executor of an estate has breached his fiduciary duty by not following the rules of probate administration or by benefiting personally from the estate, the executor can be removed and/or be held personally responsible for any monies missing from the estate.

If a trustee, likewise, has breached his fiduciary duty, he can also be removed as trustee and be personally responsible for any monies that did not directly benefit the trust and the trust beneficiaries.
